How could this be seen as anything but a blatant payoff for the trial lawyer association and insurance industry supporters.
How can this be good for anyone but the lawyers? Will we be back to the days of suing international companies in small county courts in Mississippi if you had a doctor that diagnosed you in Mississippi, if you lived in Mississippi ten years ago, or visited Mississippi once when you were a child and can testify that you really liked it ?
This is moving backward......
Companies still have to have minimum contacts with a state to be sued there. If they are enjoying the benefits of the laws of that state by doing business there, then they should expect to have to defend a suit in that state.
The problem is not the trying of these cases in a lower court. It is how many have been mishandled in the Bush federal system. What was successful in the past moved up to blatant politicizing of our Constitutional Processes. Making change benefiting the few to reel in the many for dollars is not the answer. There must be accountability. All this federal trials rule did was keep the rich and big corps out of paying for a screw up. Let's face it...If it weren't for Ambulance Chasers we might as well live in Russia or China where people disappear if they become a nuisance as you believe they are. Bush and Cheney set this thing up so they could control the outcome for campaign contributions or in some cases a bonus after they left office (Haliburton and KBR). What their idea of fair was is not the same as honestly fair. Plus it serves the purpose of companies such as Pharmaceuticals not selling snake oil to cure cancer. Liability is not a bad thing. It keeps the Neocons at bay. I'm done with it.
